Drug Diversion

A second chance to become a contributing, productive member of the community

On January 1, 2008 we began accepting Felony Drug Possession cases for Diversion under a contract with Hennepin County Community Corrections and Rehabilitation.  The structure of the program is similar to Adult Diversion, except individuals must:

bullet

Be charged with 5th Degree Possession and can not be involved with selling drugs;

bullet

Submit to random drug testing;

bullet

Complete treatment if recommended;

bullet

Participate in regularly scheduled counseling sessions with Operation de Novo; and

bullet

Have no further involvement with the criminal court system.

Like Adult Diversion, individuals have not entered a plea, nor have they been convicted of a crime.  If they complete the conditions of the program, their Counselor makes a recommendation to the County Attorney’s Office to dismiss the charge.  If they do not complete the conditions, the case is returned for prosecution.

After a charge is dismissed in both Adult Diversion and Drug Diversion, Operation de Novo also assists individuals to file the necessary paperwork for their criminal case to be expunged from public records.
